HOW TO MAKE A BEQUEST TO THE CLUB
When making a will your first priority is to ensure that it reflects the way you wish to make provision for your family and friends and other parties that you wish to benefit.
Once you have done that, making a bequest to the Club is straight forward.
You can either include the bequest when you write your will or simply make a codicil to your existing will.
However, in either case, you should seek professional advice from your lawyer to ensure that your wishes are recorded in a legally binding way and should your circumstances change, you can easily alter your will or codicil.
A suggested form of wording to use when making a bequest either in your will or codicil is set out below. However, we recommend you seek legal advice regarding the exact wording of your bequest.
You will see that you can leave a specific dollar amount, specific assets such as shares and real estate or you can leave the residue of your estate (which is what is left over after all your other gifts have been satisfied) or a percentage of the residue of your estate.
The suggested form of wording also makes it clear that your gift will be for the general purposes of the Club but you can make your gift for a more specific purpose but before doing so you or your lawyer should contact the Club to discuss this on a confidential basis.
SUGGESTED FORM OF WORDING FOR A BEQUEST
I GIVE to GOSFORD SAILING CLUB LIMITED ACN 000 703 462 of 28 Masons Parade, Gosford New South Wales (“the Club”):
(a) all of my residuary estate [delete if not applicable]; or
(b) [insert] percent of my residuary estate [delete if not applicable]; or
(c) the sum of $[insert] [delete if not applicable]; or
(d) [insert list of asset or assets] [delete if not applicable].
to be applied for the general purposes of the Club and I DECLARE that the receipt by the Secretary or a director of the Club will be an absolute discharge to my executors who will not be bound to see to the application of this gift.
